We (“Amanacard”) are committed to maintaining the confidentiality and security of your Personal Information. Please read the following terms of the Privacy Policy carefully to understand our practices and how we will treat your Personal Information.
Amanacard is registered as a data controller with the UK Information Commissioner’s Office with registration number ZA344270. This Privacy Policy describes how Amanacard collects and uses your personal information, including the information you provide on the portal: www.myamana.direct, owned and operated by Huozhi Ltd (“we”,” us”, or “our”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.
Amanacard is concerned with protecting the privacy of any personal information that you may choose to provide to us (“Personal Information”). Amanacard will attempt to ensure that the use of your Personal Information is compliant with the General Data Protection Regulation, (Regulation (EU) 2016/679) (“GDPR”) and Canada’s Federal Personal Information Protection and Electronic Documents Act, S.C. 2000, ch. 5 (“PIPEDA”). Accordingly, Amanacard issues this policy to inform you of our use of your Personal Information.
1.1 This Privacy Policy sets out how Amanacard collects and processes Personal Information, and the steps we take to protect that information.
1.2 By using our Services you confirm that you have read, understood and agree to this Policy, and consent to our use of your Personal Information for the purposes set out in Section 3. If you do not provide the requested information you may be unable to use some or all of our Services.
1.3 Capitalised terms not defined here have the meanings given in the User Agreement.
1.4 The portal www.myamana.direct is operated by Huozhi Ltd.
1.5 Definitions
• “You” – the individual using Amanacard’s services
• “Personal Data” – information that identifies, or can be linked to, a specific individual
• “Visitor” – an individual who uses the public areas of the portal but has no access to restricted areas
1.6 Principles
1.6.1 Processing shall be lawful, fair and transparent
1.6.2 Data are collected for specified, explicit and legitimate purposes
1.6.3 Collection is limited to what is necessary
1.6.4 Data are accurate and kept up-to-date
1.6.5 Inaccurate data are rectified or erased without delay
1.6.6 Data are kept no longer than necessary
1.6.7 Data are kept confidential and stored securely
1.6.8 Data are not shared with third parties except as necessary to provide services
1.6.9 Data subjects may exercise access, rectification, erasure, restriction, objection and portability rights
2.1 When you register an account we collect “Personal Information”, including:
2.1.1 Device & usage data – IP address, location, browser or app type and version, operating system, referral/exit pages, visit length, page views and search terms
2.1.2 Identity documents – passport, driving licence, proof-of-address, director/shareholder information (where required for anti-money-laundering checks)
2.1.3 Contact details – email address (for Service subscription)
2.1.4 Any other information you choose to provide
2.1.5 Details you supply when contacting us (full name, address, email, search/transaction details)
2.2 We may also collect information from publicly available sources (e.g. Facebook, Google, Twitter, Instagram, LinkedIn) to meet legal obligations, improve data accuracy and enhance the Service.
3.1 We process Personal Information in line with the GDPR to:
a) provide portal services to you
b) assist our foreign-exchange partners in providing their services
c) manage and administer the portal
d) send newsletters or other targeted communications
e) notify you of portal changes
f) send trade confirmations and welcome emails
g) request transaction feedback
h) handle enquiries and complaints
i) provide anonymised statistics to third parties
j) analyse and improve our services
3.2 If you ask us to stop processing your data we will do so, but this may require us to close your account. Email service@amanacard.com to exercise this right.
3.3 We may monitor calls, emails and messages for quality assurance.
3.4 In the event that the purposes for processing change, then we will notify you as soon as practicable and seek any additional consent that may be required.
4.1 We do not disclose your data to third parties without your explicit consent except as required by law.
4.2 Limited data are shared with foreign-exchange partners to execute your transactions, collect commission, request feedback and improve our services.
4.3 We will use all reasonable endeavours to ensure that any foreign-exchange partners to whom we disclose your data is compliant with the Data Protection Act 1998 (or an equivalent standard) as regards its use and storage of your data.
4.4 Once you trade with a foreign-exchange partner, you give permission for such contributing foreign exchange company to disclose your data and transactional information to us for the following reasons:
a) to enable us to track the amount of commission payments due to us from the broker
b) to enable us to contact you to request feedback on the transaction; and
c) to improve our services to you by tailoring the Portal to your requirements.
4.5 Data may be disclosed during business sales or transfers.
4.6 We share information to comply with legal obligations or to protect Amanacard’s rights, customers or others (e.g. fraud prevention, credit-risk reduction).
4.7 If at any time you wish us to stop processing your data for the above purposes, then you must contact us and we will take the appropriate steps to stop doing so. Please note that this may mean that your account will be closed. Email service@amanacard.com to exercise this right.
5.1 Under the GDPR you have the right to: information, access, rectification, erasure (“right to be forgotten”), restriction, objection, portability, complaint and withdrawal of consent.
5.2 Email service@amanacard.com to exercise these rights. We respond within one month (extensions possible for complex requests). We may retain data for backups, fraud prevention, legal compliance and other legitimate reasons.
5.3 You may update, correct, or delete your Account information and preferences at any time by accessing your Account. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
5.4 You may decline to share certain information with us, in which case we may not be able to provide to you some or all of the features and functionality of the Service.
5.5 At any time, you may object to the processing of your data, on legitimate grounds, except if otherwise permitted by Applicable Law.
5.6 In accordance with Applicable Law, we reserve the right to withhold personal data if disclosing it would adversely affect the rights and freedoms of others. Moreover, we reserve the right to charge a fee for complying with such requests if they are deemed manifestly unfounded or excessive. Amanacard may charge a reasonable administrative-cost fee if further copies are requested.
5.7 We may use your data for the purposes of automated decision-making when displaying your activity and offers based on your trends and interest. When such processing takes place, we will request your explicit consent and provide you with the option to opt-out. We may also use automated decision making in order to fulfil obligations imposed by law, in which case we will inform you of any such processing. You have the right to object to the processing of your personal data. Email service@amanacard.com to exercise this right.
6.1 Basic personal data are retained for up to seven (7) years to meet UK tax requirements. As a policy, we retain records of personal data that we collect for a
period of 7 years.
6.2 Marketing data are kept until you withdraw consent.
6.3 We review retention regularly and delete or anonymise data when no longer required.
7.1 We collect browser and cookie information when you first navigate to our websites. We use cookies to improve your experience. Blocking cookies may reduce portal functionality.
7.2 Cookies may be set by Google Analytics or social-media widgets.
7.3 The data collected by cookies is anonymous.
7.4 Web beacons and similar technologies collect anonymised usage data for analytics and advertising.
7.5 In order to improve the Portal and the Services, we use (temporary and persistent) cookies, authorised third parties’ cookies, web beacons and/or other technologies to collect non-personally identifiable data.
7.6 By continuing to use the portal you consent to our cookie policy.
7.7 Links to third-party sites are provided for information; Amanacard is not responsible for their content or privacy practices.
8.1 Providing personal data is optional, but without it we may be unable to offer our Services.
9.1 We sometimes process data under the “legitimate interests” basis, for example to fulfil anti-money-laundering obligations or share data with affiliated companies. Identity documents may be required for large transactions.
10.1 The Service is not directed to anyone under 18 years. We do not knowingly collect data from minors. If you believe a child has provided us data, contact service@amanacard.com to request deletion.
11.1 We implement technical and organisational measures to maintain the confidentiality, integrity and availability of Personal Information. No internet transmission is completely secure; you transmit data at your own risk. Report security concerns to service@amanacard.com.
12.1 Data may be transferred to and processed outside the EEA. We take reasonable steps to ensure adequate protection.
12.2 All information you provide to us are stored on our secured servers.
12.3 Personal Information is transmitted using SSL encryption.
12.4 We may request proof of identity before disclosing data to you.
13.1 We may update this Policy from time to time. Material changes will be notified on the portal and, where appropriate, via email.
14.1 Amanacard does not collect special-category data (e.g. ethnicity, political opinions, religious beliefs, biometric or health data). We collect only the minimum data necessary to serve our customers.
